HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.7679 of 2013 ORDER:

Heard Sri Shaik Saifullah, counsel for the petitioner and the Assistant Government Pleader (Home) for respondents.

2. The petitioner prays for mandamus declaring the inaction of respondents 1 to 3 to entrust the investigation in Cr.No.10 of 2013 pending before the 4th respondent to CBCID, CCS or any other investigating authority for fair investigation and meeting out justice to his sister and punish the accused. The annexures filed along with the writ petition reflect a sordid state of human infliction on petitioner's sister.

3. After perusing the record, as counter-affidavit was not filed, the court granted time to the learned Assistant Government Pleader (Home) to produce the case file in Cr.No.10 of 2013 or ensure the presence of the investigating officer.

4. The Assistant Government Pleader places on record the judgment dated 06.03.2017 in SC No.416 of 2013 (arises out of Cr.No.10 of 2013) on the file of the II Additional Assistant Sessions Judge, Ranga Reddy District at L.B. Nagar, for the offence under Section 307 of IPC, wherein the learned Additional Assistant Sessions Judge, convicted the accused and having regard to the infliction of pain on the victim, further directed as follows:

" In this case, PW.3 is still crippled and has to be brought to the court by lifting her physically and as she is the victim of the offence committed by the accused, her rehabilitation has to be taken up the State Government as provided under Section 357-A of Cr.P.C. Hence address a letter to the Secretary, District

Legal Services Authority, Ranga Reddy District with a copy of this judgment to take necessary steps for rehabilitation of the victim PW.3."

This court while appreciating the further steps taken by the learned II Additional Assistant Sessions Judge, to avoid the delay in the matter, directs the Member Secretary, Telangana State Legal Services Authority, Hyderabad, to take up the issue forthwith through the Secretary, District Legal Services Authority, Ranga Reddy for taking necessary steps for rehabilitation of the victim i.e., Smt. Shaheen Begum, sister of the petitioner, within two months from the date of receipt of a copy of this order.

6. The writ petition is, accordingly, disposed of. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
