HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.26280 of 2016 ORDER:
This writ petition is filed seeking a writ of Mandamus declaring the provisional assessment notice for short billing Lr.No.ADE/O/RSD/KKD/F.BB.02/16-17/D.No.563 of dated 20.05.2016 issued by the fourth respondent as being illegal and arbitrary.
2. Heard the learned counsel for the petitioner and Sri M.Ravindra, learned Standing Counsel appearing for respondents 1 to 5 (Andhra Pradesh).
3. At the time of hearing, learned standing counsel in all fairness submitted that the respondents have no objection to reconsider the case of the petitioner, if the petitioner submits fresh representation. He further submitted that meanwhile the respondents are not going to insist the petitioner to pay the disputed amount.
4. Learned counsel for the petitioner submitted that the petitioner is ready to submit a representation to the third respondent.
5. Having regard to the facts and circumstances of the case and also in view of the submissions made by both counsel, the petitioner is hereby directed to submit a representation to the third respondent within a period of two weeks from today. The third respondent is hereby directed to dispose of the representation of the petitioner within four weeks from the date of receipt of the same. The respondents are further directed not to disconnect the service connection of the petitioner till disposal of the representation by the third respondent.
6. Accordingly, this writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall
stand closed.
