This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ A.2, for grant of anticipatory bail in Crime No.239 of 2019 of Subedari Police Station, Warangal, registered for the offences punishable under Sections 143, 148, 448, 427, 307, 354 and 323 read with 149 of IPC.

Heard learned counsel for the petitioner/ A2, learned Additional Public Prosecutor appearing for the respondent/ State and perused the record.

Learned counsel for the petitioner would submit that the petitioner is an innocent person and he is no way concerned with the aforesaid crime. The present case is a counter blast to the case in Crime No.238 of 2019 of Subedari Police Station, wherein he is one of the victims and L.W.3. The petitioner is falsely implicated in this case. Hence, he prayed to grant anticipatory bail to the petitioner. 4.

Learned Additional Public Prosecutor representing the respondent-State opposed to grant bail to the petitioner. 5.

The material placed on record reveals that the petitioner caught hold of the hand and tuft of the de facto complainant and dragged and assaulted her and tried to outrage her modesty. Thereafter, the petitioner along with other accused abused the mother, father and younger sister of the de facto complainant in filthy language and beat them with hands. All the accused hurled stones and damaged the roof of their house and also broken the doors of their house with an

intention to enter the house and to kill them. Having regard to the nature of allegations levelled against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. 6.

Accordingly, the Criminal Petition is dismissed. However, if the petitioner/ A.2 surrenders before the Court below concerned and move an application for regular bail, after giving prior notice to the Public Prosecutor concerned, the same may be considered in accordance with law.
