THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI APPEAL SUIT No.845 OF 1998 JUDGMENT:

There was no representation for the appellants on 28.12.2017 and 23.01.2018. Even on 28.12.2017, there was a direction of this Court to list this Appeal Suit under the caption 'for dismissal'. In that view of the matter, on 23.01.2018, this Court directed the matter to be listed on 31.01.2018 i.e., today under the caption 'for dismissal'. Yet again, there is no representation for the appellants.

Sri B. Srinivas, learned counsel appearing for the contesting respondent, is present.

The above conduct of the appellants indicates that the appellants are not interested in prosecuting the Appeal Suit. 4.

In the result, the Appeal Suit is dismissed for default. Miscellaneous Petitions, if any, pending in this Appeal Suit shall stand closed.

There shall be no order as to costs.
