This petition is filed under Section 407 of Criminal Procedure Code (for short "Cr.P.C.") to withdraw Crl.R.P.No.16 of 2018 pending on the file of the Additional District Judge, Sompeta, Srikakulam District and club with Crl.R.C.No.919 of 2018, pending before this Court The main ground urged before this Court is that the petitioner filed a petition under Section 451 of Cr.P.C. for release of the property during pendency of proceedings and the Court passed an order dated 08.03.2018 in Crl.M.P.No.227 of 2018 and released property subject to certain conditions.

Aggrieved by the order, the petitioner filed Crl.R.C.No.919 of 2018 and the same is pending for consideration, whereas the prosecution filed Crl.R.P.No.16 of 2018 on the file of Additional District Judge, Sompeta, Srikakulam District against the same order.

As two revisions are filed questioning the part of order by one party or the other, it is appropriate to withdraw Crl.R.P.No.16 of 2018 pending on the file of Additional District Judge, Sompeta, Srikakulam District to hear and decide along with Crl.R.C.No.919 of 2018, pending before this Court.

In the result, the petition is allowed. The Crl.R.P.No.16 of 2018 pending on the file of Additional District Judge, Sompeta, Srikakulam District is withdrawn to hear and decide along with Crl.R.C.No.919 of 2018 by this Court. No costs.
