THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35285 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India by the petitioner seeking to issue a writ of Mandamus, to declare the action of the respondents in not considering the representation, dated 30.01.2016, submitted by the petitioner, as illegal and arbitrary and consequently, direct the respondents to consider the representation dated 30.01.2016 of the petitioner, and further direct the respondents to settle the petitioner's policy amount pertaining to the policy No. 645816324.

Heard and perused the material available on record. Petitioner took a pension policy from the respondents in the year 2010 and paid Rs.30,000/ - per annum for five years towards premium. Since he fell sick due to cardiac problem and need money for medical treatment, he submitted a written representation, dated 30.01.2016, to the respondents for surrender of his policy and to pay back the surrender amount as per the norms of the respondents. Respondents have not taken any action on the said representation. A copy of the same is also enclosed as material paper along with the writ petition. Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on the merits of the case, the respondents are directed to take appropriate action on the representation, dated 30.01.2016, said to have been submitted by the petitioner, in accordance with law, within a period of two months from the date of receipt of copy of this order.

With the above direction, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
