HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT WRIT APPEAL No. 516 OF 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Learned counsel for the appellant prays for withdrawal of the writ appeal with liberty to the appellant to file appeal before the appellate authority as observed by learned Single Judge in the impugned order. He seeks further two weeks' time to file appeal and a direction to the 3rd respondent to decide it within timeframe.
Writ appeal is dismissed as withdrawn with liberty as prayed. If the appellant files appeal within a period of two weeks from today, the 3rd respondent shall consider and decide the same on merits in accordance with law as expeditiously as possible and preferably within a period of twelve weeks from the date of such appeal. If the appeal is filed within the stipulated time, the 3rd respondent shall entertain the same without raising any objection with regard to limitation.
