THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.8023 OF 2017 ORDER:

This writ petition is filed challenging the action of the third respondent in not registering any crime against the fourth respondent for trespass and criminal intimidation and pressurizing the petitioner to withdraw from representing his client acting on the instructions of the fourth respondent.

Learned Government Pleader, on the basis of the instructions, submits that the petitioner has not lodged any complaint in the Police Station, Narsingi, as alleged in the affidavit. However, the fourth respondent lodged a private compliant before the XXII Metropolitan Magistrate, Cyberabad, at Rajendranagar, Ranga Reddy District, against the petitioner and others and the petitioner was shown as accused No.1. A notice under Section 91 of Code of Criminal Procedure was issued on 04.02.2017 and the petitioner in stead of cooperating with the investigation filed the present writ petition.

In view of the registration of crime against the petitioner, no further orders can be passed except directing the petitioner to cooperate with the investigating officer. In view of the allegation that the petitioner has not lodged any complaint, it is open to the petitioner to lodge complaint, if the petitioner is aggrieved, and he is at liberty to take appropriate action in accordance with law if the complaint is not registered by the police. The writ petition is accordingly closed.
