HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.25090 OF 2017 ORDER:

The case of the petitioner is that the 2nd respondent without following due process of law has straightaway issued the impugned notice dated 29.06.2017 asking the petitioner to remove the compound wall constructed by the petitioner in layout admeasuring Ac.37.95 cents, in R.S.No.591/P, 592/1, 2, 593/1, 2, 3, 4, 5A, 5B, 5C and 594/1, 3, 3B, 598/1, 2, 1B, and 600/2, in Ward No.13 of Nuzvid town, Krishna District, which is illegal and arbitrary.

Heard learned counsel for the petitioner.

Learned Standing Counsel appearing for the 2nd respondent submits that the petitioner has already submitted explanation to the impugned notice and that the respondent authorities will pass orders in the same, in accordance with law. Since it is stated that the petitioner has already submitted explanation to the impugned notice dated 29.06.2017, it is for the 2nd respondent to consider and dispose of the same. In view of the same, the writ petition is disposed of directing the 2nd respondent to pass orders by considering the explanation of the petitioner, in accordance with law, within a period of three weeks from the date of receipt of a copy of this order. Till then Status quo obtaining as on today shall be maintained.

Accordingly, the writ petition is disposed of. No order as to costs.
