THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.8088 OF 2017 ORDER:

The writ petition is filed challenging the order of rejection of the representation of the petitioner, dated 29.01.2017, by proceedings, dated 10.02.2017 holding that the petitioner is ineligible to be considered for allotment of LPG distributorship.

The case of the petitioner is that the first respondent issued notification on 15.09.2013 for appointment of LPG distributors in various places of Telangana and Andhra Pradesh and one of the locations is Eluru-3, West Godavari District. He applied under Open (Government Personnel) Category. The father of the petitioner was a police constable in Hyderabad City Police and expired while in service. Accordingly, the petitioner applied under the said category.

It appears that the first respondent addressed a letter on 21.03.2016 asking the petitioner to submit a certificate from Head of Office or an Officer not below the rank of Under Secretary to Government stating that the father of the petitioner died while he was performing duty, but the petitioner states that the said communication was not received by the petitioner and now the impugned order was passed making him ineligible.

Today when the matter is taken up for consideration, learned counsel for the first respondent produced before this Court a copy of the letter, dated 21.03.2016, whereby the petitioner was asked to submit a certificate from the Head of Office or an Officer not below the rank of Under Secretary to Government stating that his father expired while performing duty. The first respondent fairly submitted that no final selection was made with regard to the second respondent and if necessary certificate is produced, they would consider the application of the petitioner along with other eligible applications. In the circumstances, liberty is given to the petitioner to submit the required information within two weeks from the date of receipt of copy of this

order for considering the case of the petitioner along with other eligible applicants in accordance with law.
