THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.7701 OF 2016 ORDER:

This petition is filed under Section 482 of Criminal Procedure Code (for short "Cr.P.C.") to quash the proceedings in Crime No.183 of 2016 on the file of Chanda Nagar Police Station, registered for the offence punishable under Section 500 of Indian Penal Code (for short "I.P.C.").

Sri S.V.Ramana, learned counsel for the respondent No.2, fairly conceded that the police are not competent to register a crime for the offence punishable under Section 500 of I.P.C. and on a private complaint, the Court can take cognizance as per procedure and sought for permission to file a private complaint before the competent Court while quashing the proceedings. In view of the concession of Sri S.V.Ramana, learned Counsel for the respondent No.2, the petition is allowed and the proceedings in Crime No.183 of 2016 on the file of Chanda Nagar Police Station are hereby quashed, giving liberty to the complainant to file a fresh private complaint before the competent Court. No costs.

The miscellaneous petitions pending, if any, shall also stand closed.
