THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.11841 of 2018 ORDER:
Heard learned counsel for the petitioner and the learned Government Pleader for Agriculture.
When the matter is taken up, it is brought to the notice of this Court that, in identical set of circumstances, this Court disposed of W.P.No.5053 of 2018 by way of an order, dated 15.03.2018. A copy of the said order is placed on record. Operative portion of the said order reads as under:
"In the light of the above, it is evident that respondent No.2 had retained adulterated neem cake worth Rs.27,000/-. Since departmental proceedings are yet to be concluded, interest of justice would be served if a direction is issued to respondent No.2 to release bank guarantee of Rs.3,20,000/- furnished by the petitioner subject to its furnishing bank guarantee for a sum of Rs.27,000/- within a period of two weeks from today".
In view of the same, there shall be the following similar order in this case also:
In the light of the above, it is evident that respondent No.2 had retained adulterated neem cake worth Rs.61,600/-. Since departmental proceedings are yet to be concluded, interest of justice would be served if a direction is issued to respondent No.2 to release
bank guarantee of Rs.5,27,000/- furnished by the petitioner subject to its furnishing bank guarantee for a sum of Rs.61,600/- within a period of two weeks from today.
Subject to the above direction, the Writ Petition is disposed of. There shall be no order as to costs". Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
