THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5963 of 2015 ORDER:
This criminal petition is filed by the petitioner - accused No.1 under Sections 437 & 439 of the Criminal Procedure Code, seeking to grant bail in S.C. No.212 of 2013 on the file of XIII Additional District and Sessions Judge, Gajuwaka.
Heard and perused the material available on record. The allegations against the petitioner are that he along with other accused committed decoities at various houses and there are so many cases pending against him.
Taking into consideration the seriousness of the offences, this Court expressed its opinion that this Court is not inclined to grant bail to the petitioner. At this stage, learned counsel for the petitioner submitted that earlier the schedule for trial of the case was fixed, but due to non-availability of the judicial officer, the same could not be completed and now a new judicial officer has been appointed, therefore, a direction may be given to the Court below for early disposal of the case.
In view of the same, the Criminal Petition is disposed of directing the XIII Additional District and Sessions Judge, Gajuwaka, to fix schedule for trial of S.C. No.212 of 2013 and proceed with the case and dispose of the same in accordance with law as expeditiously as possible, preferably within a period of three (3) months from today. ______________ RAJA ELANGO, J July 03, 2015 KTL
