THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.14063 of 2019 ORDER:

Heard.

2. Petitioners claim that a registered General Power of Attorney (GPA) was executed by the owners of the land to an extent of Acs.5.23 guntas in survey No.348 situated at Garmilla Village, Mancherial Mandal and District. As a consequence to the said GPA, petitioners are protecting the property of the owners. Petitioners also narrated the history of the title and claim that the subject land is a private patta land whereas respondents 3 to 5 now sought to interfere and threaten to dispossess the petitioners from the said land and the same is illegal.

Learned Government Pleader submits that on the basis of the complaint lodged by Ch.Satyanarayana alleging that in spite of taking sale consideration, the first petitioner herein failed to register the property, crime No.248/2019 is registered under Section 420 IPC on 19.06.2019 in Mancherial Town Police Station and investigation is in progress.

4. Learned counsel for the petitioner sought to contend that no prior notice is issued to them, no enquiry is conducted and the Police did not visit the site in connection with said crime. Learned counsel would further contend that the respondents sought to dispossess the petitioners without following due process.

5. Even assuming that there is alleged interference in respect of the subject land, petitioners, not being the owners, cannot complain of such illegal interference. Therefore, this Writ

Petition is dismissed leaving it open to the property owners to work out their remedies as available in law.

Miscellaneous Petitions pending in this writ petition, if any, shall stand closed. No order as to costs.
