Heard Sri Chetluru Srinivas, learned counsel appearing for the petitioner and the learned Government Pleader for Civil Supplies for the State of Andhra Pradesh appearing for the respondents.
2. This writ petition is filed seeking to declare the action of the 2nd respondent-RDO, Kalyandurg, Anantapur district in issuing the show cause cum suspension order vide Rc.No.380/2015E, dated 08-4-2015, passed by the 2nd respondent as illegal, void, arbitrary and contrary to the provisions of the Andhra Pradesh State Public Distribution System (Control) Order, 2008 and Essential Commodities Act and set aside the same.
3. The fair price shop of the petitioner was inspected on 08-42015 and certain variations have been allegedly noticed. Among the variations, there is shortage of 160 litres of kerosene oil against the allotment of 712 litres of kerosene oil, which is not within the permissible limits. Some other allegations were mentioned in the show cause notice. Basing on the said allegations, the authorization of the petitioner was suspended by order dated 08-4-2015.
4. Having regard to the allegations mentioned in the show cause notice, this Court is of the view that an enquiry is required to be conducted in the matter. Consequently, the writ petition is disposed of directing the 2nd respondent-RDO to conduct enquiry into the allegations levelled against the petitioner and pass final orders within a period of 8 (eight) weeks from the date of receipt of a copy of this order. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs. ___________________
