Petitioner claims to be absolute owner and possessor of land to an extent of Ac.3.05 guntas in Sy.No.757/A/1 of Rajeswarapuram village, Nelakondapalli Mandal, Khammam district. Petitioner alleges that on 19.06.2019, Tahsildar along with his subordinates and others tried to interfere with his peaceful possession and enjoyment over the subject property and tried to lay a road through his land without acquisition. In other words, petitioner alleges that the revenue authorities are illegally laying a road in a private land without following due process.

On a specific question posed by the Court, the learned counsel for petitioner is unable to answer as to how revenue authorities are interfering and laying a road. At the most revenue authorities may identify the land, which is already vested in the Government, or the land was already acquired. It is either the Panchayat Raj Department or R&B Department or the Gram Panchayat would lay the road, but not by Revenue Department. Therefore, the allegation that in the guise of laying a road, respondents are trying to interfere with his possession, has no basis. Even the photographs would show that some persons are indulging in some activity. Therefore, Court is not inclined to entertain the Writ Petition on the premise that revenue authorities are laying a road. Thus, leaving it open to petitioner to work out his remedy against any interference of private land, Writ Petition is dismissed. Pending miscellaneous petitions shall stand dismissed.
