THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 28251 OF 2017 O R D E R:
The main grievance of the petitioners is that the respondent police have been harassing them and interfering with their life and liberty.
It is the case of the petitioners that merely because they are native of Adinarayanapuram, Chirala Mandal, Prakasam District, they have been branded as Stuvartpuram gang and they are being constantly harassed by the police. They allege that they were forced to confess their involvement in some false cases. The petitioners further submit that they are the law-abiding citizens and if their presence is required in connection with any crime, they would attend before the police as per the procedure prescribed. Heard learned counsel for the petitioners.
Learned Government Pleader for Home (Andhra Pradesh), on receipt of instructions, submits that FIR No. 82 of 2017 dated 01.07.2017 has been registered and during the course of investigation into the said crime, it has been revealed that the petitioners have involved therein and hence, their confessional statements have been recorded. It is further submitted that the investigation is in progress and the police would take necessary steps in accordance with law.
Having considered the submissions made by the learned Government Pleader for Home, inasmuch as a crime has been registered against the petitioners, the Writ Petition is closed leaving
it open to the petitioners to avail the remedies in accordance with law. No costs.
Consequently, the miscellaneous Applications, if any shall stand closed.
