THE HON'BLE SRI JUSTICE R. SUBHASH REDDY AND THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA WRIT PETITION No.35330 of 2015 ORDER: (Per Hon'ble Sri Justice R. Subhash Reddy) This writ petition is filed for a Mandamus to declare the action of respondent Nos.3 to 5 in not admitting the petitioner into Under Graduate Medical course for the academic year 2015-16 under BC-B category, as illegal and arbitrary, and to issue consequential direction to the respondents to forthwith admit the petitioner into the said course for the academic year 2015-16.

The petitioner has completed his Intermediate education and appeared for EAMCET-2015 examination and secured the rank of 4978. As per the admission programme notified by the 5th respondent University, the classes for Under Graduate Medical courses have started from 01.09.2015.

In this writ petition, it is the grievance of the petitioner that as some students have secured admission under BC category by producing fake caste certificates, on complaints thereof, such admissions, numbering seven, were cancelled and, as such, in consequential vacancies, the petitioner is eligible for admission. Precisely, it is the grievance of the

petitioner that for admissions obtained by some students on false caste certificates, the petitioner is denied admission. In this case, it is to be noticed that as per the judgments of the Hon'ble Supreme Court, the admissions into Under Graduate Medical courses are to be closed by 30th September of every year. Further, even as per the instructions of learned Standing Counsel appearing for the 5th respondent, classes have commenced from 01.09.2015. Even if some admissions are to be cancelled on the allegation that they were secured on false caste certificates, there cannot be any direction to admit the petitioner straightaway, as there may be more meritorious candidates than the petitioner in Backward Class category. Further, as classes are commenced nearly two months back, any direction now will disturb the academic schedule itself. In that view of the matter, no direction as prayed for, can be issued at this stage.

Accordingly, the writ petition is dismissed. No order as to costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
