THE HONOURABLE SRI JUSTICE M. LAXMAN CRIMINAL PETITION No.5093 OF 2023 ORDER:

This Criminal Petition is filed seeking to grant regular bail under Sections 437 and 439 of Criminal Procedure Code, 1973 (Cr.P.C). The petitioner is accused No.2 in Crime No.456 of 2021 of Madhapur Police Station, Cyberabad. The offences alleged against the petitioner are under Section 370 (A) (2) of Indian Penal Code, 1860 and Sections 3, 4 and 5 of the Immoral Traffic (Prevention) Act, 1956.

The sum and substance of case of the prosecution is that the petitioner is allegedly running brothel at Room No.10, 4th floor, Royal Inn Oyo Hotel, above Apna Bazar, 100 feet Road, Madhapur, with the active assistance of accused No.1. 3.
Heard both sides.

It is submitted that the petitioner is in remand since 05.05.2022, most of the investigation is completed and in connected matter also the petitioner was granted bail. Further, trial is not possible in the present matter in near future and further, detention of the petitioner is unwarranted.

Considering the above background of the facts, this Court is inclined to grant bail to the petitioner/accused No.2 on certain terms and conditions.

Accordingly, the Criminal Petition is allowed and the petitioner/accused No.2 shall be released on bail on the following terms and conditions:
(i) The petitioner/accused No.2 shall be released on bail on his executing a personal bond for Rs.25,000/- (Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of the X Additional Metropolitan Magistrate, Ranga Reddy District at Kukatpally.
(ii) The petitioner/accused No.2 shall not directly or indirectly influence or make any witnesses or complainant. (iii) The petitioner/accused No.2 shall not indulge in similar type of offences till conclusion of trial and if it is found that the petitioner is involved in similar type of offences in future, the bail granted to him shall automatically stands cancelled and he shall be taken into custody forthwith.
(iv) The petitioner/accused No.2 shall make available with the investigating agency for proper investigation and he shall fully cooperate with the investigation agency. He shall not at in any manner which will be prejudicial to fair and expeditious investigation.
