HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.4568 of 2015 ORDER:

Heard both sides.

2. The petitioner is the HT consumer, who questioned the demand notices issued to it by respondents 1 to 4 primarily on the ground that they are share holders of 4th respondent which generates power and supplies to them and in that capacity, the petitioner's industry received power from the 5th respondent, as such the power so received and consumed by the writ petitioner from the 5th respondent is required to be given credit to, while demanding the consumption charges from it by respondents 1 to 3.

3. Mr. O. Manohar Reddy, learned standing counsel appearing for respondents 1 to 3 submits, on the basis of instructions from the Superintending Engineer (Comml.), TSPCC/TSTRANSCO, Vidyut Soudha, Hyderabad - 500 082, dated 7.1.2015, that the first respondent has received details of breakup figures of allocations with regard to the power generated by the 5th respondent and supplied to its share holders and based on the figures now available, respondents 1 to 3 proposed to take those shares into consideration and revise the impugned proceedings accordingly. Since the impugned proceedings are being revised by the respondents 1 to 3 themselves and they proposed to issue appropriate revised demand notice to the writ petitioner, no further orders are necessary in this writ petition. However, the writ petitioner as well as 5th respondent are at liberty to question the revised demand notice in accordance with law if they feel aggrieved of the same.

4. The writ petition is accordingly disposed of. Miscellaneous
