Heard.

The petitioner herein is a School, which states that it was permitted to open classes I to VII during academic year 2014-15 vide proceedings of the 1st respondent-District Educational Officer, Prakasam District, dated 04-02-2014. Thereafter, the petitioner has submitted a detailed application for grant of recognition. The Mandal Educational Officer is stated to have inspected the School and submitted a report and the proposal is already being examined by the District Educational Officer, Prakasam District. While so, under the impugned proceedings (Ex.P-1) dated 08-10-2014, the 1st respondent found that the proposal submitted by the Mandal Educational Officer is not in conformity and hence, the same was returned directing Mandal Educational Officer to resubmit the proposal, after rectifying the defects raised by the M.L.A., Chirala.

The said proceedings of the 1st respondent is questioned in this writ petition. Learned Government Pleader has received instructions, which state that the report from the Mandal Educational Officer rectifying the defects, as pointed out in the impugned proceedings, dated 08-102014 is still awaited. It is also stated that further course of action will be taken up by the 1st respondent after receipt of proposal from the Mandal Educational Officer.

I do not see any reason as to why the petitioner is questioning the said proceedings, inasmuch as it is not addressed to the petitioner and it only called for a rectified report from the Mandal Educational Officer. It is, therefore, for the Mandal Educational Officer to rectify the defects and submit a proposal, so that the District Educational Officer will take a final decision in the matter.

Since it is on the own saying of the petitioner that it was permitted to open Classes from I to VII for the academic year 2014-15, I do not see any reason for the petitioner to be aggrieved by the said proceedings of the District Educational Officer, dated 08-10-2014.

Hence, the writ petition is dismissed. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
