HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.4157 OF 2018 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. by the petitioners/A.10, A.17, A.18, A.22, A.23, A.25, A.28, A.32, A.33 and A.35 seeking to quash the proceedings against them in C.C.No.169 of 2017 on the file of Judicial Magistrate of First Class, Podili, Prakasam District. Having regard to the fact that C.C. is now coming up for framing charges and that the contention of the petitioners that they have not availed any loans from the SBI, Podili Branch but A.1 to A.5 who are owners of the Cold Storages, in Podili, in collusion with A.83 the then Branch Manager, SBI, manipulated certain loans in the name of petitioners, can be decided only after full-fledged trial, it is directed that trial shall take place in this matter.

However, considering the request of the learned counsel for the petitioners, the appearance of the petitioners/A.10, A.17, A.18, A.22, A.23, A.25, A.28, A.32, A.33 and A.35 is dispensed with in C.C.No.169 of 2017 on the file of Judicial Magistrate of First Class, Podili, Prakasam District except on the occasions when their attendance is required by the trial court.

This Criminal Petition is disposed of accordingly. As a sequel, miscellaneous applications pending if any, shall stand closed.
