HON'BLE SRI JUSTICE R. KANTHA RAO W.P.No.12120 of 2015 ORDER:

In W.A.No.317 of 2015, an issue identical to the present one fell for consideration before Division Bench of this Court and the Division Bench while setting aside the order passed by this Court took the view that this Court ought not to have interfered with the interim order of suspension and directed the Revenue Divisional Officer to conduct enquiry and pass speaking order within one month after issuing notice and affording opportunity of hearing to the petitioner.

In view of the above, the Writ Petition is disposed of directing the 3rd respondent-Revenue Divisional Officer to complete the enquiry within a period of one month from the date of receipt of a copy of this order. If the enquiry is not completed within the time stipulated above, the order of suspension will stand revoked and the petitioner shall be allowed to resume his dealership, pending enquiry. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
