THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI Contempt Appeal No.3 of 2018 JUDGMENT: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} This appeal, under Section 19 of the Contempt of Courts Act, 1971 (for short "the Act"), is preferred against the order passed by the Learned Single Judge in C.C.No.1283 of 2016 dated 02.08.2017. By the said order the Learned Single Judge, while finding no merit in the Contempt Case, dismissed it with costs of Rs.1,000/- to be paid to the High Court Legal Services Committee. Aggrieved thereby, the present appeal.
Section 19 of the Act relates to appeals and, under Sub-section
(1) thereof, an appeal shall lie as of right from any order or decision of High Court in the exercise of its jurisdiction to punish for contempt. In the present case, the Learned Single Judge has not imposed any punishment and, on the other hand, has dismissed the Contempt Case. No appeal lies, under Section 19 of the Act, against the order of the Learned Single Judge dismissing the Contempt Case. The Contempt Appeal fails and is, accordingly, dismissed. Miscellaneous petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
