HON'BLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.1819 of 2014 ORDER:

By order dated 31.10.2013, this Court disposed of W.P.No.29004 of 2013 directing t h e District Collector-cum-Project Director,, National Highway-5, Srikakulam (1st respondent) to dispose of the appeal filed by the petitioners and pass appropriate orders within a period of three months from the date of receipt of copy of that order. Alleging that orders of this Court are not complied with, this contempt case is filed.

2. During the pendency of the contempt case, the District Collector, passed final orders on the appeal on 10.12.2014.

3. Having regard to the fact that delay in complying with the orders passed by this Court, the respondent-District Collector filed an affidavit explaining the reasons. According to him, earlier he could not take immediate steps to finalize the appeal proceedings in view of the notification of General Elections since he was the District Election Officer and Returning Officer to Srikakulam Parliamentary Constituency. After the conclusion of the General Elections, he was again involved in attending to the cyclone relief operations after 'Hudud' cyclone. In view of the same, the said delay was occurred. The District Collector expressed an unconditional apology on account of the delay in passing the orders and not complying with the orders within the time fixed by the Court. The said affidavit is taken on record.

4. Having regard to the fact that the orders as directed by the Court are already complied with, the contempt case is closed. Miscellaneous petitions pending, if any, in this case shall stand closed.
