THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.18653 OF 2017 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking to declare the inaction of respondent No.2 in taking legal action against respondents 3 to 9, who are committing nuisance in front of the house of the petitioners, as illegal and arbitrary.
Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Home. With their consent, the Writ Petition is disposed of at the stage of admission itself. Since this Court is not going into the merits of the case, there is no necessity to issue notice to unofficial respondents herein i.e. respondents 3 to 9.
The grievance of the petitioners is that since 05.06.2017, the unofficial respondents raised a tent in front of the house of the petitioners, thereby causing inconvenience to the family members of the petitioners and also intending to cause obstruction to the marriage of the first petitioner.
Learned AGP would submit that no report was given to the Police by the petitioners till date and if any report is given, suitable action will be taken.
Having regard to the above, the Writ Petition is disposed of directing the petitioners to give a fresh report to respondent-Police ventilating their grievance, in which event, the respondent-Police shall take necessary steps in accordance with law.
Miscellaneous petitions pending in this writ petition, if any, shall stand closed. There shall be no order as to costs. ________________________ C. PRAVEEN KUMAR, J 22.06.2017 sur
