THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 3583 of 2022 ORDER:

This Criminal Petition filed under Section 439 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking to modify the conditions imposed by the Special Judge for Economic Offences, Hyderabad in Crl.MP No. 850 of 2022, dated 11.04.2022 in F.No. DRI/HZU/48D/Enq-08/ 2022.

Heard the learned counsel for the petitioner and learned Spl. Public Prosecutor and perused the record. 3.

The Special Judge for Economic Offences, Hyderabad granted bail to the petitioner/accused in Crl.MP No. 850 of 2022 in F.No. DRI/HZU/48D/Enq-08/(int-08)/2022 with conditions that the petitioner/accused shall execute a personal bond for Rs.5,00,000/- (Rupees Five Lakhs only) with two sureties for the like sum each to the satisfaction of this Court of which one surety must be the close relative of the petitioner/accused and that the petitioner/accused shall appear before the respondent/ complainant agency once in

fortnight i.e. on 1st and 3rd Monday of every month between 10.00 A.M. and 5.00 P.M until further orders. It is further directed that the petitioner/ accused shall not leave the country without prior permission of the Court and that he shall not threaten or tamper the evidence and shall cooperate with the investigating agency in completion of investigation in fair manner, as and when required. 4.

The counsel for petitioner submits that the entire material is seized and though bail was granted he is not in a position to furnish sureties, as such he is in jail. No purpose would be served and the petitioner would remain in jail due to his incapacity. For the said reason the surety amount of Rs.5,00,000/- (Rupees Five Lakhs only) is reduced to Rs.50,000/- (Rupees Fifty Thousand only) and the other conditions shall remain unaltered.

Accordingly, the criminal petition is allowed in part. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
