THE HON'BLE SRI JUSTICE T. VINOD KUMAR Writ Petition No.14173 of 2019 ORDER:

The present writ petition is filed seeking a Writ of Mandamus to declare the issuance of notice dated 01.06.2019 by the 2nd respondent, in respect of the house bearing Nos. 4-241 to 4-247 in Survey No.277, Patel Complex, Pargi, Vikarabad District, as per se illegal, arbitrary and contrary to law, rules and natural justice.

Heard Sri B. Shankar, learned counsel for the petitioners and the learned Government Pleader for Social Welfare appearing for the 1st respondent and Sri Abu Akram, learned counsel for the 2nd respondent.

The learned counsel for the 2nd respondent would fairly submit that he has impressed upon his client to continue the tenancy up to 29th February, 2020. However, since the 2nd respondent is making necessary arrangements for continuing the Intermediate College at the new premises, they may be permitted to partially move it from the petitioners' premises. The learned counsel for the petitioners also has no objection to the 2nd respondent determining the tenancy from 01.03.2020 and also for the partial move out from the premises of the petitioners during the period up to 29.02.2020.

The writ petitioners and respondents submit that in view of the amicable settlement that is arrived, the averments made by both the parties either in the notices or in the pleadings may be treated as withdrawn against the other and not to have any bearing in future.

Having regard to the said submissions and agreement between the parties, the writ petition is closed with the observation that the 2nd respondent shall vacate and hand over the premises to the petitioners by 29.02.2020 and the tenancy relating to the petitioners' property, with the 2nd respondent shall stand determined with effect from 01.03.2020. However, there shall be no order as to costs. As a sequel thereto, Miscellaneous Applications, if any, pending in this writ petition shall stand closed. ___________________ T.
