HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No:36342 OF 2016 ORDER:

The present writ petition is filed by the petitioners seeking to quash the proceedings against them in FIR No.203 of 2016 on the file of the 3rd respondent.

It is stated in the affidavit that the 4th respondent filed a complaint against the petitioners before the 2nd respondent and subsequently, she withdraw the same voluntarily on the ground that she decided to separate from her husband and she will approach the family court for permanent alimony. Subsequently, she again filed a complaint with false allegations and the same was registered as FIR No.203 of 2016. It is the case of the petitioners that they never committed any offence. 3.

The petitioners are challenging the investigation in the above crime. This Court is not inclined to interfere with the investigation in the above crime. However, considering the fact that the present complaint has arisen out of matrimonial disputes, this Court is of the view that the investigation can be completed without arresting the petitioners. 4.

Accordingly, respondents No.2 & 3 are directed to complete the investigation and file a report in the above crime, in accordance with law in either way, without arresting the petitioners. 5.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ____________________ JUSTICE RAJA ELANGO Dated: 27th October, 2016 Nn.
