Heard counsel for the petitioners and the Government Pleader for Revenue appearing for respondents. 2.

It is stated by counsel on either side that the issue in this Writ Petition is covered by the decision of this Court rendered on 06.03.2019 in W.P.No.17350 of 20181.

Therefore, for reasons alike, this Writ Petition is also allowed and the impugned order dt.10.10.2018 passed by the 3rd respondent is set aside, since the instant case also falls within the ambit of the Act of 1977 and the 3rd respondent could not have invoked the provisions of A.P. Land Encroachment Act, 1905. This order however will not preclude the respondents from taking recourse to the applicable enactments in relation to the lands under petitioners' occupation and follow the procedure prescribed there under. No order as to costs.

Consequently, Miscellaneous Petitions pending if any, shall stand closed.
