Petition under Section 438 of Cr.P.C praying that in the circumstances stated in the Memorandum of Grounds of Criminal Petition, the High Court may be pleased to release the petitioner on bail in the event of his arrest pending lnvestigation, Inquiry and Trial in connection with the Crime No.38 of 2022 on lhe file of Police Station, Kamatipura, Hyderabad, otherwise the petitioner shall suffer irreparable loss.

This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri K. PRADEEP REDDY, Advocate for the Petitioner and the Public Prosecutor on behalf of the Respondent.

THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.3584 of2022 ORDER:

This Criminal Petition under Section 438 Cr.p.C. is filed by petitioner/ accused No.l seeking bail in the event of his arrest in connection with Crime No.38 /2022 on the fi1e of Kamatipura Town Police Station, Hyderabad, registered for the offences punishable under Sections 376 of Indian Penal Code and 6Z of ITA Act, 2OOg. 2.

The allegation against the petitioner is that he raped the daughter of defacto complainant when she was 9 years old. Subsequently, even after marriage, A1 and A2 have been threatening her and ,{2 posted some nude photographs of the daughter of complainant in you Tube channel.

In the said circumstances, the relief of Anticipatory Bail cannot be granted to this petitioner/A1. However, if so advised, the petitioner/A1 may surrender before the concerned Court within 1O days from the date of this order and seek regular bail and on such surrender, the concerned court is directed to dispose of the petition within three working days.

Accordingly, the Criminal Petition is disposed of. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
