ORDER

This Criminal Petition is filed under Section 482 Cr.P.C. to quash the proceedings in C.C.No.2 of 2016 on the file of I Additional Special Judge for CBI Cases, Visakhapatnam.

2. Heard the learned counsel for the petitioner/A8 elaborately and the learned Additional Public Prosecutor representing the State.

3. From a perusal of the record, it cannot be said that there is no material to proceed against the petitioner/A8. Therefore, it is not a fit case to quash the proceedings against it. The truth or otherwise of the allegations against the petitioner/A8 can only be decided during the course of the trial.

4. In that view of the matter, this Criminal Petition is disposed of directing the I Additional Special Judge for CBI Cases, Visakhapatnam, to proceed with the trial and dispose of C.C.No.2 of 2016 expeditiously, without insisting on the presence of the petitioner/A8, which is a company. Needless to say that the petitioner/A8 is at liberty to approach the Court below and seek appropriate remedy including its discharge and the Court below shall dispose of the same on merits.

5. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
