Sri V.Krishna Mohan, learned counsel for the applicant, submits that Sri V.Vijaya Rama Raju, Advocate of this Court, is the Arbitrator being nominated by his client. Taking note of the fact that the Arbitrator appointed by the respondent survives, the person suggested by the applicant is appointed as the Arbitrator nominated by the applicant. It would be open to the Arbitrators to appoint Umpire in accordance with the provisions of the Arbitration and Conciliation Act.
