This civil revision petition arises out of order dt.30.11.2015 in I.A. No.861 of 2015 in M.V.O.P. No.51 of 2012, on the file of the Motor Vehicles Accidents Claims Tribunal-cum-District Judge, Narasaraopet.
The petitioner is one of the three claimants in M.V.O.P. No.51 of 2012. The Lok Adalat Bench at Narasaraopet, passed an Award granting certain amount and apportioning the compensation among the three claimants, including the petitioner. As regards the petitioner, a sum of Rs.2,50,000/- (Rupees two lakhs and fifty thousand only) was awarded, out of which Rs.50,000/- (Rupees fifty thousand only) was permitted to be withdrawn immediately, and the balance amount of Rs.2,00,000/- (Rupees two lakhs only) was directed to be kept in Fixed Deposit for a period of three years. Even before the expiry of the period stipulated under the Award for withdrawal, the petitioner has filed I.A. No.861 of 2015 for grant of permission to withdraw the amount. The Tribunal has dismissed, and in my view rightly, the said application filed by the petitioner.
In my opinion, so long as the Lok Adalat Award remains unaltered, the petitioner is not entitled to withdraw the deposit amount before the expiry of the period for which it was directed to be kept in fixed deposit under the Award. Therefore, unless the petitioner seeks amendment of the Lok Adalat Award by way of a review, she is not entitled to withdraw the fixed deposit amount prematurely. The Tribunal has therefore rightly dismissed the application of the petitioner.
Hence, I do not find any merit in this civil revision petition and
the same is accordingly dismissed.
As a sequel to dismissal of the civil revision petition, C.R.P.M.P. No.251 of 2016 shall stand disposed of as infructuous. ______________________ C.V. NAGARJUNA REDDY, J 22-01-2016 bnr
