Heard learned counsel for the petitioner, learned Government Pleader for Municipal Administration and Urban Development for respondent No.1 and S.Prabhakar Reddy, learned Standing Counsel for respondents 2 to 4. 2.

On the building permission application submitted by petitioner, he was communicated with shortfall letter dated 14.06.2019. In the said letter two shortfalls are mentioned. The first one deals with pending Writ Appeal No.200 of 2014 and the second one deals with failure in PreDCR.

With reference to the first objection, it is seen from the Court record that W.A.No.200 of 2014 was dismissed as withdrawn by order dated 13.08.2018. Thus, no writ appeal is pending. Therefore, the objection raised for processing the building permission application submitted by petitioner on the ground of writ appeal pending is not valid and to that extent the same is set aside.

However, subject to petitioner complying with the 2nd objection, the respondent-Corporation is directed to process the building permission application submitted by the petitioner without reference to the first objection.
