Learned counsel for the petitioner seeks permission of this Court to withdraw the criminal petition with a liberty to file an application under Section 167(2) Cr.P.C. before the competent court. Permission is accorded.

Accordingly, the criminal petition is dismissed as withdrawn granting the liberty as sought for.
