This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the inaction of respondent Nos.2 and 3 in allotting the essential commodities in favour of the petitioner Fair Price Shop No.12, Kurichedu Village and Mandal, Prakasam District, during subsistence of the authorization as illegal, arbitrary and consequently direct the respondents to release the essential commodities in favour of the petitioner, for distributing the same to the cardholders.

The predominant contention of the learned counsel for the petitioner is that the authorization of the petitioner was not suspended by the second respondent.

The learned Assistant Government Pleader submitted that the second respondent suspended the authorization of the petitioner Fair Price Shop No.12 on 26.02.2016.

A perusal of the record reveals that the second respondent passed the order on 26.02.2016 by suspending the authorization of the Fair Price Shop No.12 of the petitioner.

The only relief sought by the learned counsel for the petitioner is that the second respondent may be directed to dispose of the matter as expeditiously as possible.

In view of the submission made by the learned counsel for the petitioner, this Court is not inclined to go into the factual aspects of the case.

Having regard to the facts and circumstances of the case, the second respondent is hereby directed to dispose of the disciplinary

proceedings, if any, initiated against the petitioner in accordance with law, as expeditiously as possible, preferably within a period of one (1) month from the date of receipt of a copy of this order. Accordingly, the Writ Petition is disposed of. No costs. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
