This writ petition is filed seeking to issue a Writ of Mandamus to declare the action of the 4th respondent in rejecting the application of the petitioner for power supply vide letter Ref.No.DEE/OP/B'Pally/Sec'bad/T/F.Rejection/D.No.2193/2020, dated 18.09.2020, to the petitioner premises admeasuring 400 Sq.Yds., in Sy.No.376/A, Rajiv Gandhi Nagar, Kukatpally, Hyderabad, as illegal.
Heard the learned Counsel for the petitioner and the learned Counsel for the respondents.
Sri Pilli Nagaraj, learned Counsel for the petitioner states that the petitioner is the lessee of the premises admeasuring 400 Sq.Yds., in Sy.No.376/A, Rajiv Gandhi Nagar, Kukatpally, Hyderabad having taken on lease on 17.09.2020. The petitioner approached the respondent authorities with a request to provide 25HP/KW power supply connection by way of submitting an application and also paid requisite fee.
Learned Counsel for the petitioner would submit that the 4th respondent without considering the application submitted by the petitioner in proper perspective and the contents therein, has rejected the said application, directing him to approach the competent Court and get a direction for power release vide impugned proceedings. He would further submit that when similar issue was raised in respect of M/s.Sri Sai Traders, M/s.Durga Industries and M/s.Rajugari Industries and others, the respondents have granted service connection in favour of the said firms, but when it comes to petitioner, the respondents are denying
AAR,J WP.No.16529/2020 the same illegally. Therefore, he contends that appropriate orders be passed directing the respondents to consider the case of the petitioner on par with similarly situated firms in whose favour service connection were granted.
Learned Standing Counsel appearing for the respondents had contended that since IDPL has raised objections, the case of the petitioner would be considered and appropriate orders would be passed, if the petitioner submits a fresh representation only. This Court vide order dated 10.08.2020 in Writ Petition No.12171 of 2020, while dealing with the very same subject lands in respect of the very same Survey Number, has passed orders permitting the petitioner therein to file a fresh representation before the authorities, for grant of service connection on par with M/s.Sri Sai Traders, M/s.Durga Industries and M/s.Rajugari Industries and directing the official respondents to consider the same and pass appropriate orders in accordance with law within a period of eight (8) weeks thereafter.
In view of the above order passed by this Court in Writ Petition No.12171 of 2020 and for reasons alike, the petitioner is permitted to submit their representation afresh for grant of service connection on par with the other industries, which have already been granted service connection, within a period of one week from the date of receipt of a copy of this order and thereupon, the official respondents shall consider the said representation and pass appropriate orders in accordance with law, within a period of eight
(8) weeks thereafter. The impugned proceedings vide letter Ref.No.DEE/OP/B'Pally/Sec'bad/T/F.Rejection/D.No.2193/2020, dated 18.09.2020, are hereby set aside.
