THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.15891 of 2016 ORDER:
The petitioner was appointed on 27.12.2010 as Deputy General Manager (Materials Management) and he was initially posted in New Delhi. Thereafter, he was transferred to Mannavaram in Srikalahasthi Mandal of Chittoor District. He was promoted on 01.07.2014 as Senior Deputy General Manager (Materials Management) and was retained at Mannavaram itself. When he was transferred on 13.10.2015 from Materials Management wing to the Projects side and posted to the Namrup Project in Assam State by release order dated 09.11.2015, the present Writ Petition is filed challenging the said order of transfer. Learned Counsel for the petitioner submits that the petitioner has no knowledge with regard to the duties to be discharged in Projects wing of the second respondent Organisation and he has experience in the Materials Management only.
Though several other averments are made in the Writ Petition relating to the transfer, learned Counsel for the petitioner submits before this Court that the transfer order is vitiated on the ground of lack of experience in the Projects side. This Court feels that such a ground is not available for challenging the order of transfer as it is for the employer to utilize the services of the employee in a manner it sees proper. This Court is incompetent to examine whether the petitioner's services can be utilized in the Projects side or Materials Management side.
In the circumstances, the Writ Petition is dismissed at the admission stage. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. ________________________________
