THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.5901 OF 2017 ORDER:
This Writ Petition under Article 226 of the Constitution of India is filed by the petitioner seeking to declare the action of the respondents in surveying the lands of the petitioner admeasuring 196.3 Sq.Yards (Ac.0.04 cents) and 96.8 Sq. Yards (Ac.0.02 cents) in RS No.82/1A situated at Tadepally Village and Mandal, Guntur District, for the purpose of laying a road without following due process, as illegal and arbitrary.
Heard the learned counsel for the petitioner as well as the learned Government Pleader for Municipalities. The limited grievance of the petitioner in this writ petition is that the respondents are trying to encroach the lands of the petitioner for the purpose of laying a road, without following due process of law.
Per contra, learned Government Pleader would submit that any interference by the respondents-officials would only be in accordance with law.
Having regard to the rival submissions made, the Writ Petition is disposed of directing the respondents not to interfere with the possession of the petitioner over the subject lands except by following due process of law.
Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
