ORDER

This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused No.1 in Crime No.58 of 2026 before the Kuravi Police Station,

Mahabubabad District, registered for the offence punishable under Sections 34(E) of TSEA, 7A read with 8E of TSPA. 2.

The brief facts of the case are that a case was registered by Kuravi Police Station on 19.03.2026. While conducting vehicle checking at Nerada X Road, Kuravi village, police intercepted an Ashok Leyland Lorry moving suspiciously. On search, the police allegedly found 140 bags of black jaggery weighing about 14,000 kgs, 20 bags of alum weighing about 1,000 kgs, and 20 litres of ID liquor. The driver and others were apprehended, while some accused were shown as absconding.

Heard Sri A. Shiva Sainath, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner contended that the petitioner is innocent and has been falsely implicated in the case and that the petitioner was not present at the scene of offence and no incriminating material was recovered from his possession. He further submitted that the entire case against

the petitioner is based solely on the alleged confessional statement of co-accused, which is inadmissible in law. He contended that the petitioner is a trader in jaggery, and the police have been repeatedly implicating him in similar cases without basis. Counsel also pointed out that the petitioner has been in judicial custody since 20.03.2026 and investigation has already been completed. Therefore, he prayed the Court to grant bail to the petitioner by allowing this Criminal Petition.

Learned Additional Public Prosecutor opposed the bail application contending that the petitioner is involved in transporting materials used for preparation of illicitly distilled liquor along with contraband liquor itself and that huge quantities of black jaggery, alum, and ID liquor were seized from the vehicle and the investigation revealed the petitioner's role through the statements of co-accused. He contended that considering the seriousness of the offence and the material collected during investigation, the petitioner is not entitled to bail. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the petitioner is in jail since 20.03.2026. As seen from the record, the material part of the investigation has been completed and L.Ws.1 to 8 witnesses have been examined.

Considering the facts and circumstances of the case and the incarceration period of the petitioner, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the Additional Judicial Magistrate of First Class, Mahabubabad District.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of

investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
