HON'BLE SRI JUSTICE P. KESHAVA RAO CRIMINAL REVISION CASE No.1770 of 2005 ORDER:

Heard the counsel for the petitioner.

The present revision case is filed questioning the judgment dated 20.10.2005 passed in Crl.A.No.325 of 2004 on the file of the Court of the III Additional Sessions Judge, Tirupathi confirming the judgment dated 02.12.2004 passed in C.C.No.370 of 1999 on the file of the Court of the III Additional Judicial Magistrate of First Class at Tirupathi, convicting the petitioner for the offence under Section 138 of the Negotiable Instruments Act.

During the course of hearing, it is brought to the notice of the Court by the learned counsel for the petitioner, by producing a Xerox copy of the death certificate issued by Births and Deaths Registrar, Renigunta Grampanchayat, Chittoor District. The said certificate shows that the petitioner died on 01.05.2010. Therefore, the proceedings against the petitioner, automatically abates by virtue of her death on 01.05.2010.

Accordingly, the criminal revision case is dismissed as abated. Miscellaneous petitions, if any, shall also stand dismissed. ___________________ P. KESHAVA RAO, J Date:16.08.2018.
