THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO WRIT PETITION No. 2317 OF 2015 O R D E R:

The petitioner herein, while working as a Junior Assistant with one of the temples at Gajuwaka, has been placed under suspension as he has been arrested by the local police into certain grave allegations levelled against him and his family members. However, he has now been enlarged on bail and the complaint in this Writ Petition is that the subsistence allowance payable to the petitioner which was ordered to be 50% of his pay initially has now been reduced to 25%. Hence, this Writ Petition.

The management of the temple will realize that only in the event the petitioner is not cooperating with conducting the enquiry promptly, can they reduce the subsistence allowance payable to him from 50 to 25%. On the other hand, if the petitioner is cooperating with the enquiry and he is proceeding with the same, the subsistence allowance cannot be reduced.

Therefore, let an appropriate reasoned order be passed in this regard within a maximum period of 15 days. However, since the petitioner has already been placed under suspension, the enquiry contemplated against him shall also be completed as expeditiously as is possible, preferably within a period of three months from the date of receipt of a copy of this order.

With this, the Writ Petition stands disposed of. No costs. Consequently, the miscellaneous applications, if any shall also stand disposed of.
