No representation for petitioner.

The petitioner prays for Mandamus declaring inaction of respondents in not restoring fair price shop authorisation to petitioner as requested through representations, dated 07-07-2011 and 08-022012 as illegal, arbitrary and amounts to not exercising jurisdiction vested on the respondents.

The premise on which the writ is founded is that the petitioner has clear acquittal in the criminal case filed by the Department against her and she is entitled for automatic restoration of fair price shop authorisation.

The Assistant Government Pleader, on instructions, submits that the very basis on which the writ petition is filed is erroneous and there is more than one reason not to restore the fair price shop authorisation to petitioner. Even assuming that criminal case filed by the Department ended in acquittal, the prayer is one against inaction of respondents in disposing of the representations filed by petitioner and the authorities cab be directed to pass orders on pending representations.

At this stage, this court can direct the respondents to pass appropriate orders on the representations, referred to above, but ought not to get into reasons for not restoring the fair price shop dealership to petitioner.

Therefore, the writ petition is disposed of by directing respondents 3 and 4 to pass and communicate orders on representations, dated 07-07-2011 and 08-02-2012, within eight weeks from the date of receipt of a copy of this order. No order as to

costs.
