HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY Writ Petition No. 36930 of 2012 ORDER :

The petitioner is the absolute owner and possessor of house (pent house) situated in 6th floor in SS Residency, situated at Jyothinagar locality of Karimnagar Town. He has constructed the said pent house in the year 2009.

The entire apartment has been constructed after obtaining necessary permission from the first respondent.

Though the petitioner made application seeking permission for construction of the pent house, the first respondent neither granted permission nor refused the same. Therefore, the petitioner has constructed the same under the deemed provisions of the Act. However, the other flat owners of SS Residency gave complaint to the first respondent with regard to the construction made by the petitioner. The petitioner made representation 23.07.2012 to the first respondent for regularizing the said flat, but so far, the same has not been considered by the first respondent. Aggrieved by the same, the present writ petition is filed.

2. Heard Sri P.Sajan Kumar, learned counsel for the petitioner and Sri V.Satyam Reddy, learned Standing Counsel for the respondents. 3.

Since the representation made by the petitioner dated 23.07.2012 is pending with the first respondent, the first respondent is directed to dispose of the same and pass appropriate orders in accordance with law.

With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
