HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.14081 OF 2019 ORDER:

This writ petition is being disposed of at the admission stage with the consent of both parties.

This writ petition is filed seeking the following relief: "..to pass an order or orders one in the nature of WRIT OF MANDAMUS declaring the action of the Respondent No.2 for non-payment of the remuneration of Rs.85,606/- from February, 2017 to September, 2017 i.e., total 8 months is Rs.6,84,848/- as per the proceedings of the Respondent No.2's File No.982/E1/MCK/2017 as per the Agreement dated 23.02.2017 vide resolution No.1204 for period of 6 months as illegal, arbitrary and against the principles of natural justice."

Heard Sri K. Buchi Babu, counsel for the petitioner, and Sri C.Kalyan Rao, Standing Counsel for the 2nd respondent. It has been contended by the petitioner that during February, 2017, he was appointed as Smart City Co-ordinator on contract basis on remuneration of Rs.85,606/- per month and he has continued for eight months and thereafter his services were disengaged. The grievance of the petitioner is that though he has rendered service for eight months, the respondents have not paid remuneration for the period he has worked. Therefore, he submitted a representation to the respondents on 26.10.2018 staking his claim for payment of remuneration for the period he has worked, but so far the respondents

have not passed any orders on the said representation nor considered his case for payment of remuneration for the period he has worked. Therefore, counsel for the petitioner contended that appropriate orders be passed in the writ petition directing the respondents to consider the representation submitted by the petitioner and pass appropriate orders in accordance with law.

Standing Counsel appearing for the respondents had contended that since the petitioner's representation is pending with the respondents, the respondents would consider the same and pass appropriate orders in accordance with law.

This Court, having considered the submissions of learned counsel for the respective parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 26.10.2018 and pass appropriate orders in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. With the above directions, the writ petition is disposed of. No order as to costs.
