Heard the learned counsel for the petitioner and Smt.Anjali Agarwal, learned Standing counsel for the respondents. This writ petition is filed challenging the impugned proceedings bearing File No.2072231166919, dated 27.06.2019, issued by the respondents.

Learned counsel for the petitioner contends that the respondents are not issuing Passport in favour of the petitioner on the ground that Criminal Cases vide CC.No.153/2014, CC.No.584/2014, CC.No.282/2016 and CC.No.

315/2016 under the Negotiable Instruments Act, 1881 are pending against the petitioner. Learned Standing counsel appearing for the respondents had contended that as per the Gazette Notification dated 25.08.1993, petitioner has to approach the competent Criminal Court to obtain permission for obtaining Passport.

This Court, having considered the rival submissions of the respective parties, is of the considered view that this writ petition can be disposed of directing the petitioner to approach the competent Criminal Court where criminal cases are pending, seeking permission of the Court to obtain Passport.

With the above direction, this writ petition is disposed of. No order as to costs.

Pending miscellaneous applications, if any, shall stand closed in consequence.
