P.R. Man Singh, Sec. v. Starlets Cricket Clul And Ano
THE HON'BLE SRI JUSTICE S.V.BHATT C.R.P.Nos.2129, 2130, 2131, 2132, 2133, 2134 & 2135 of 2012 COMMON ORDER:
On 11.09.2018, CRP.No.2129 of 2012 and batch was adjourned at the request of Advocate Mr.Gangadhar Rao and directed to be listed on 25.09.2018. Much earlier to 11.09.2018, the request of Mr.Mir Masood Khan to communicate with the revision petitioner was considered and reasonable time was granted. Mr.Mir Masood Khan informs the Court that being the Advocate on record, keeping in view the rules governing the relationship between counsel and client, he has sent the communication about the listing of cases and that the Court is not granting time, by registered post acknowledgment due and the electronic media available. He further informs the Court that he is not appearing in the case as on date, for inspite of best efforts he is not getting instructions from his client.
On 06.11.2018, the batch of CRP's was listed and there was no representation for petitioners and after seeing the docket proceedings, the CRP's were directed to be listed under the caption 'for dismissal'.
Mr.Mir Masood Khan requests the Court to grant some more reasonable time. The request of Mr Mir Masood Khan made in his capacity as a responsible counsel is rejected. The matters since are listed under the caption 'for dismissal' and also that these CRP's are of the year 2012, this Court is of the view that the petitioners, if conduct litigation complacently, the request for adjournment for the sake of asking, ought not be granted.
For the above reasons, the CRP's are dismissed for default. No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed.
