IA.No.1 of 2018 is filed by the petitioner/appellant/defendant ('appellant', for brevity) requesting for permission to withdraw the Appeal Suit filed against the decree & judgment, dated 06.04.2015, in O.S.No.110 of 2008, on the file of the Principal District Court, Nellore. 2.

Sri T.Balamohan Reddy, learned counsel, appearing for the appellant, submits that the appellant and the respondent/plaintiff are brothers and that at the intervention of elders and well-wishers, both the parties decided to withdraw the litigations against each other without any claims against each other in respect of the suit schedule property and that, therefore, the present Application is filed. 3.

Sri K.S.Gopalakrishnan, learned counsel appearing for the respondent, is present.

Having regard to the submissions now made and the submissions in the affidavit filed in support of the Application, permission is accorded and the Application is ordered. 5.

As a sequel, the Appeal Suit is dismissed as withdrawn. There shall be no order as to costs.
