HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.4155 OF 2018 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. by the petitioners/A.2 to A.4 seeking to quash the proceedings against them in C.C.No.99 of 2016 on the file of XV Additional Chief Metropolitan Magistrate at Hyderabad, which according to the information furnished is in the stage of appearance of the accused. Having regard to the stage of the matter, this Court is of the considered view that the trial court can take up the issue with regard to the discharge of the petitioners.

Hence, while dismissing this Criminal Petition, liberty is given to the petitioners to file appropriate application seeking their discharge, in which case the trial court shall pass appropriate orders on merits.

Considering the request of the learned counsel for the petitioners that all the petitioners are aged persons, their appearance is dispensed with before the trial court except on the occasion when their presence is required by the trial court. As a sequel, miscellaneous applications pending if any, shall stand closed.
